29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about October 27, 2016, at the above addressed jobsite, employees were working within the interior area of the third floor of a townhouse, for which the stairs had not yet been installed and for which the stairwell opening did not have a guardrail, which resulted in one of the employees falling from the third floor to the second floor, resulting in the serious injury and subsequent hospitalization of the employee. NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): On or about October 27, 2016, at the above addressed jobsite, employees were working within the interior area of the third floor of a townhouse, of which the stairs had not yet been installed, and for which the stairwell opening did not have a guardrail, and for which the employer did not ensure that a designated competent person conducted frequent and regular inspections of the job site, materials and equipment, which resulted in one of the employees falling from the third floor to the second floor, resulting in the serious injury and subsequent hospitalization of the employee. NOTE: CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
