29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1m) above a lower level was not protected from falling to that lower level by fall protection established in accordance with paragraphs (g)(1)(i) through (vii) of this section: On or about October 28, 2016, and at times prior thereto, a makeshift scaffold was constructed to frame the restaurant under construction up to 18 feet high without guard rails or personal fall arrest systems, exposing workers to a fall hazard.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access: On or about October 28, 2016, workers were framing the restaurant under construction approximately 16 feet high using a 24 foot extension ladder to access the scaffold platform without extending at least 3 feet above the upper landing surface, exposing the workers to a fall hazard.

29 CFR 1926.454(b): The employer did not have each employee who was involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question: On or about October 28, 2016, and at times prior thereto, the employer did not have the superintendent trained in the hazards of scaffolding, exposing workers to a fall hazard. The training shall include the following topics, as applicable: a) The nature of scaffold hazards; b) The correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question; c) The design criteria, maximum intended load-carrying capacity and intended use of the scaffold; d) Any other pertinent requirements of this subpart.
