OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer is failing to protect employees from the hazards of struck by and crushing. This violation was most recently documented on or about November 2, 2016 at 4400 E. Hwy 30, Kearney, Nebraska in the yard area. Freightliner FL-70 was identified with deficiencies such as, but not limited to, oil level and pressure, lights not functioning, horn inoperable, safety belt inoperable, wipers and fluid, and gauges. Among other methods, the following are feasible and acceptable methods to correction: a) Ensure that all employees involved in the operation of this truck are trained on the importance of the vehicle inspection and operating the vehicle: If anything is nonfunctioning that affects the safety of the operator or the operation of the vehicle, the vehicle shall be removed from service until repaired. b) Ensure that all employees of the company follow both the manufacturers recommendations in the operators manual. c) Ensure that all features of the vehicle are functioning prior to putting the vehicle into service. d) In accordance with the operators manual - If the pre-operation checks identify an item related to safe operation of the vehicle or safety of the driver is identified the vehicle shall be removed from service until such time as it can be brought back into a safe and serviceable condition.

This violative was most recently documented on or about November 2, 2016 at 4400 Highway 30, Kearney, Nebraska 68628. The Nissan 35 powered industrial truck, model MCP1F1A-18LV ID number K0046 seat belt was frayed and did not functionally retract.
