29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.  On or about November 1, 2016, the employer failed to ensure that employees were protected from falling from tractor trailer tanks located inside the facility. Employees perform repairs and various other tasks from the top of the tanks which range in height from 7 top 10 feet. Employees were provided and utilized personal fall arrest systems however they had not been reviewed by a competent person. Furthermore, the employees used the overhead trusses of the building as anchor points which were not reviewed by an engineer to withstand a fall event.
