29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. (a) New townhome construction on Lot #43, Front side: On or about November 2, 2016, and at times prior, the employer exposed employees to eye injuries as employees operated pneumatic nail guns at 120 PSI, in that protective eyewear was not provided to employees installing cornice boards and Hardie-Plank Lap Siding.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. (a) New townhome construction on Lot #43, Front side: On or about November 2, 2016, and at times prior, the employer exposed employees to fall hazards of 32-feet, 2-inches from a pump jack scaffold platform, in that personal fall arrest systems or guardrails were not provided to employees installing cornice boards and siding.
