29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  Lucio Perez, dba Lopez Roofing, does not provide training to employees which would allow them to recognize and avoid unsafe conditions, or to understand and follow the OSHA Standards that apply to construction work, to include  but not limited to, the proper use of personal protective equipment, power tools, extension cords, flammable liquids, ladders, and fall protection.  This violation was most recently observed at 1257 Carmen Ave. Sheboygan, WI on November 4, 2016.  Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including copies of the training materials and the names and qualifications of the persons it is designating as competent.  Lucio Perez was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1157686, citation number 1, item number 1A, and was affirmed as a final order on 8/24/16, with respect to a workplace located at 1026 High Ave, Sheboygan, WI 53081.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    Each employee on a residential roof, with unprotected sides and edges is not protected from falling by complete, properly installed and maintained fall protection systems. This violation was most recently observed at 1257 Carmen Ave, Sheboygan, WI where employees were not protected from falls between 9' and 16' to ground from a steep pitch roof.  To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than 6' above another level without adequate fall protection.     Pursuant to 29 CFR 1903.19m the employer must submit documents describing the steps it is taking to ensure compliance, including the names and qualifications of the persons it is designating as competent, and a description of their responsibilities.        Lucio Perez, dba Lopez Roofing, was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 966821, citation number 1, item number 1, and was affirmed as a final order on 7/29/14, with respect to a workplace located at 1241-1243 Cameron Cir. Neenah, WI 54956.    Lucio Perez, dba Lopez Roofing was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1157686, citation number 2, item number 1, and was affirmed as a final order on 8/24/16 , with respect to a workplace located at 1026 High Ave. Sheboygan, WI 53081.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  Each employee on a residential roof, with unprotected sides and edges is not trained to recognize and avoid or correct fall hazards, to understand and follow the OSHA Standards for fall protection, or to properly install, use and maintain fall protection systems.
