29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides. (a) The employer did not insure storage platform (mezzanine) above supervisors office was guarded by a standard railing and with a toeboard. This exposed employees to a fall hazard and struck by hazard.

Retraining of the operator did not occur to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. (1) The Crown electric forklift, Model RM 6025-45, serial # 1A443721 had a damaged positive battery cable with exposed copper wire. The exposed copper wire was in contact with the metal battery case in the forklift, exposing the forklift operator and other associated employees to an electrical shock hazard and fire hazard.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. (a) Inspection of forklifts are not being performed prior to being placed into service. Observation of Crown electric forklift (model # RM6000, serial # 1A443722) in operation, identified an exposed bare copper battery cable that was in contact with the metal battery housing of the forklift. This exposed employees to an electrical shock and electrical fire hazard.

29 CFR 1910.303(b)(1): Electrical equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees: (a) The employer did not ensure the electrical panel used to open the walk-in freezer door was free from electrical shock hazard. The panel cover was damaged and pulled away from the electrical box, creating a three (3) inch opening between the panel cover and box. This exposed employees to an electrical shock hazard of 480 Volts AC. (b) The employer did not ensure exit sign located at South East exit was free from electrical shock hazard in that plastic insert was missing exposing electrical wiring. This exposed employees to an electrical shock hazard of 120 volts AC.
