29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) Jobsite, on or about 11/4/16: Employees were not wearing protective helmets while cleaning roofing debris that had accumulated below the workers on the roof. Employees on the ground were exposed to being struck-by roof debris, power tools and other construction materials.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Jobsite, on or about 11/4/16: Employees engaged in roofing activities were not protected from falling 22 feet 8 inches by the use of guardrail systems, safety net system, or personal fall arrest system. Kevin Donath General Contracting, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1005372, citation number 01, item number 001 and was affirmed as a final order on 12/03/14, with respect to a workplace located at 259-261 Buckingham Avenue, Syracuse, NY 13210.
