29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:    (a) Advanced Recycling Systems, LLC at 3509 W. Teem Dr., Sioux Falls SD, 57107:  On or before 10/26/2016, confined space hazards where workers were required to make full body entry into equipment such as but not limited to an Harris Brand Baler Machine and a distribution chute without the benefit of a written program that identifies and mitigates the hazards prior to entering the space.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:     (a) Advanced Recycling Systems, LLC. at 3509 W. Teem Dr. Sioux Falls SD, 57107:  On or before November 7, 2016 workers were exposed to electrical and amputation hazards where the employer did not establish an energy control program that included procedures and training to isolate hazardous energy when required on equipment such as but not limited to the sorter, baler, and various conveyors.

29 CFR 1910.303(g)(2)(i): Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating  at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i):     (a) Advanced Recycling Systems, LLC. at 3509 W. Teem Dr. Sioux Falls SD, 57107:  On and before November 7, 2016 three sorter workers were exposed to electrical hazards when operating electrical controls located inside a 230V electrical panel with live electrical parts exposed.

There shall be no damaged parts that may adversely affect safe operation or mechanical strength of the equipment, such as parts that are broken, bent, cut, or deteriorated by corrosion, chemical action, or overheating.   (a) Advanced Recycling Systems, LLC. at 3509 W. Teem Dr. Sioux Falls SD, 57107:  On and before November 7, 2016 employees were exposed to electrical hazards where broken light switch faceplates exposed live electrical terminal screws.

29 CFR 1910.305(g)(1)(iv)(A): Flexible cords and/or cables were used as a substitute for the fixed wiring of a structure:   (a) Advanced Recycling Systems, LLC @ 3509 West Teem Drive, Sioux Falls, SD  57107:  On and before November 7, 2016, employees were exposed to shock hazards in that a flexible extension cord was used in lieu of permanent wiring to power two fixed fans on the conveyor chutes.  This cord was located on the mezzanine floor, next to the stairs and down to a lower level where it was energized.
