29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:     The employer is failing to protect employees from caught between and struck-by hazards associated with operating and maintaining equipment without having developed or implemented written specific procedures for securing stored energy.  This was most recent occurrence of this was evident during the inspection of the facility located at 13800 S. 54th Street, Roca, NE; where the employer has maintenance employees replacing/repairing the tarp control arm assembly on side dumper trailers without having developed and implemented written procedures that outline the step by step process necessary to safely release the stored energy for that equipment.  Instances of exposure include but are not limited to:               i.        Employees maintaining the trucks and trailers have never seen or heard of written specific procedures.            ii.        Employees repairing/replacing tarp control arm assemblies without having written procedures available.           iii.        Employees maintaining the Freightliner material trucks (dump trucks) dump bed without having written procedures available.

The employer is failing to train employees on the hazards associated with operating and maintaining equipment that requires having the hazardous energy isolated prior to operating or maintaining it. The most recent occurrence took place at the facility located at 13800 S. 54th Street, Roca, NE where the employer has maintenance employees using hydraulic fluids, motor oils, and greases to perform preventive maintenance and repairs on the companys fleet of vehicles without having developed and implemented a written HAZCOM program.  Instances include but are not limited to:           i.  The company has not developed and documented a list of the chemicals they have on site and employees use.          ii.  The company has not outlined the methods the employer will use to inform employees of the hazards of non-routine tasks.         iii.  The company has not identified the types of labeling supporting the changes made in HAZCOM as they relate to the Global Harmonization Standards, nor how they will ensure that all chemicals are labeled.         iv.  The company has not identified the changes made from Material Safety Data Sheets to Safety Data Sheets in HAZCOM as they relate to the Global Harmonization Standards.         v.  The company has not identified the methods the employer will use to train employees on the hazards associated with the types of chemicals the company has them using.
