OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that road construction employees were exposed to struck-by hazards:    a)Dakota Contracting Corporation @ 49th Street and Empire, Sioux Falls, SD 57106:  On or about November 4, 2016 and at times prior, the employer did not ensure that employees were protected from struck-by hazards, in that two members of a road construction work crew were exposed to being struck by motorists while working within a road construction zone in low-light conditions without wearing and/or covering their high visibility reflective vests.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)   a)Dakota Contracting Corporation @ 49th Street and Empire, Sioux Falls, SD 57106: On or about November 4, 2016, and at times prior, employees were not provided training with regard to the health hazards of hazardous chemicals with which they worked.  These chemicals included abrasive blasting materials, and respirable silica.

29 CFR 1904.29(b)(1): 29 CFR 1904.29(b)(1):  The OSHA 300 log of work-related injuries and illnesses, 300A summaries, and first report of injuries were not completed in detail.   a)On or about November 4, 2016, and at times prior, the OSHA 300 log for Calendar Year 2016 was not completed in detail.  Each entry was marked as a Days Away from Work Case (Column H), but no days away from work were indicated in Column K.  No cases were marked as Job Transfer or Restriction or Other Recordable Case (Columns I and J).    b)On or about November 4, 2016, the OSHA 300A provided for Calendar Year 2016 indicated that 12 cases with days away from work occurred but there were no days indicated in total number of days away from work.
