OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that road construction employees were exposed to struck-by hazards: a)Dakota Contracting Corporation @ 49th Street and Empire, Sioux Falls, SD 57106: On or about November 4, 2016 and at times prior, the employer did not ensure that employees were protected from struck-by hazards, in that two members of a road construction work crew were exposed to being struck by motorists while working within a road construction zone in low-light conditions without wearing and/or covering their high visibility reflective vests.
