29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means shall be fully lowered, controls shall be neutralized, power shall be shut off, and brakes set. Wheels shall be blocked if the truck is parked on an incline.  (a)  SW Corner of the warehouse - On or about November 9, 2016 an employee was exposed to a fall hazard while riding on an unauthorized wooden pallet used as a scaffold. This pallet was elevated by a Toyota forklift model 8FGU 50 serial no. 10523243.  This pallet was not secured to the forklift.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.  (a) SW Corner of the warehouse - On or about November 9, 2016 an employee was exposed to a fall hazard while riding on an unauthorized wooden pallet used as a scaffold. This pallet was elevated by a Toyota forklift model 8FGU 50 serial no. 10523243. This pallet was not designed by the manufacture to be used as a platform to transport employees.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a)  Shelves Counter inside the warehouse - On or about November 9, 2016 an employee was exposed to a fall hazard while standing on shelves 12 feet above concrete with no fall protection.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a)  Shelves Counter inside the warehouse - On or about November 9, 2016 employees were exposed to a flying object hazard while using a metal sledge hammer to install metal shelves.  Neither of these employees was wearing eye protection.  The employer did not enforce the wearing of safety glasses on this job-site.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  (a)  Custom Product Corporation - On or about November 9, 2016 the employer did not ensure industrial operator training once every 3 years. The forklift operator has not been re-certified in over 10 years. The forklift driver hoisted an employee on an unauthorized wooden pallet.
