29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer is failing to ensure that all employees are protected from fall hazards when entering and exiting the landing surface of a residential roof. This most recently occurred on November 9, 2016 on the jobsite located at 2423 N 148th St, Omaha, NE 68116. Employees are using a ladder to enter and exit the roof to perform reroofing duties and did not have the side rails extended to at least 3 feet above the landing surface. The landing surface is approximately 9.5 feet above the ground.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: The employer is failing to ensure that all employees exposed to fall hazards while working on a residential roof are utilizing fall protection. This most recently occurred on November 9, 2016 on the jobsite located at 2423 N 148th St, Omaha, NE 68116. Employees were observed reroofing the residence on a 12 in 12 steep sloped roof at heights of approximately 9.5 feet above the ground. Armando Martinez, dba Martinez Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1170948, citation number 1, item number 1, and was affirmed as a final order on August 24, 2016, with respect to a workplace located at 10560 Sapp Brothers Drive, Omaha, NE 68138.
