On or about November 2, 2016 and at times prior thereto, the ladder at the Motel 6 worksite, 6001 Rogers Avenue, Fort Smith, Arkansas had shingles placed on the first ladder rung and in front of the ladder exposing employees to trip hazards.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. On or about November 2, 2016 and at times prior thereto, at the Motel 6, 6001 Rogers Avenue, Fort Smith, Arkansas, employees were using a portable metal extension ladder to access the second story roof that did not extend at least three feet above the upper landing surface. This condition exposed employees to fall hazards.
