29 CFR 1926.103: NOTE: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.134 of this chapter. 29 CFR 1910.134(f)(2): The employer did not ensure that employees using a tight-fitting facepiece respirator were fit tested whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: a) The employer required the employee mixing Terrazzo to wear a 3M N95 Model 3210 two strap filtering facepiece respirator to protect the employee from respirable dust and was not fit tested prior to initial use, on this style of respirator, and annually thereafter.

29 CFR 1926.59: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200 of this chapter. 29 CFR 1910.1200(e)(1)(i): The written hazard communication program did not include a list of the hazardous chemicals known to be present, using an identity that was referenced on the appropriate material safety data sheet: a) On November 10, 2016, Menconi Terrazzo, LLC did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would include the following: 1) A complete list of hazardous chemicals known to be in the workplace. Employees were exposed to hazardous chemicals, including irritants including Terroxy Resin Systems - Terrazzo Matrix, Part B (amines and phenols), Terroxy Resin Systems - Iso-Crack Epoxy Membrane, Part B (amines and phenols), Terroxy Resin Systems - Primer, Part A (phenols), Terroxy Resin Systems - Primer, Part B (amines and phenols), and Terroxy Resin Systems - WB Urethane Sealer (amines).
