29 CFR 1910.252(a)(2)(iv): Cutting or welding was permitted in areas before the areas were inspected by the individual responsible for authorizing cutting and/or welding: Aft Mechanical Space: The employer did not ensure that the area where an employee of an outside contractor was assigned to repair a fuel tank of a boat using a TIG welder was inspected by a responsible individual prior to allowing the task. On or about 11/01/2017, while the employee of the outside contractor was performing the above task, the fuel tank exploded, and the contractor employee sustained very serious injuries from the incident.

29 CFR 1910.252(a)(2)(vi)(C): Cutting or welding was permitted in the presence of explosive atmospheres (mixture of flammable gases, vapors, liquids, or dusts with air), or explosive atmospheres that could develop inside uncleaned or improperly prepared tanks or equipment which had previously contained such materials Aft Mechanical Space: The employer did not ensure through performing appropriate measures and steps that the fuel tank of a boat was adequately and properly prepared prior to allowing an employee of an outside contractor to repair the fuel tank utilizing a TIG welder. On or about 11/01/2017, while the employee of the outside contractor was performing the above welding task, the fuel tank exploded, and the contractor employee sustained very serious injuries from the incident.
