29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there was an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees: On or about November 15, 2016, and at times prior thereto, employees were exposed to health hazards while demolishing an area of an existing parking lot without using personal protective equipment. a) Employees were operating and working near a Hilti DSH 700 hand-held gas powered saw, used to cut up and demolish an existing concrete driveway, without using respirators, masks or any other type of respiratory protective equipment. b) Employees were operating and working near a Sullair pneumatic jackhammer, used to demolish an existing concrete driveway, without using any type of hearing protective equipment.

29 CFR 1926.59: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met: On or about November 15, 2016, and at times prior thereto, the employer did not have a hazard communication program that adequately addressed hazardous properties of chemicals in the workplace, such as, but not limited to, respirable crystalline slilica, classified as a human lung carcinogen, and associated employee training required.
