29 CFR 1926.453(b)(2)(i): Lift controls shall be tested each day prior to use to determine that such controls are in safe working condition.    a.  On the site where a Sky Jack aerial Lift was used to elevate an employee up to the sign for painting, the employer did not inspect the equipment prior to use thereby exposing the employee to a fall hazard.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).    a.  At the sign in front of the Shopping complex, the employer did not ensure the employee who were working from a aerial lift were wearing fall protection to protect from a fall hazard.

29 CFR 1926.454(b): The employer shall have each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question. The training shall include the following topics, as applicable:    29 CFR 1926.454(b)(2): The correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question;    a.  On the site where an employee was working in a Sky Jack Aerial Lift to paint a sign, the employer did not provide scaffold training on working in the aerial lift thereby exposing employees to a fall hazard.
