29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   a) Green Nissan, LLC: On November 15, 2016, and at times prior, employees were exposed to struck by hazards associated with not receiving forklift training and evaluation prior to operating the orange Toyota forklift.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a)  South Wall Shop:  On or about November 15, 2016, and at times prior, employees were exposed to struck by hazards while working in and around the unguarded Napa 20 ton hydraulic press.  b)  South Wall Shop:  On or about November 15, 2016, and at times prior, employees were exposed to caught in hazards while using the unguarded Precision brake lathe.

29 CFR 1910.303(g)(1)(i): Work space was less than 30 inches wide in front of electric equipment operating at 600 volts, nominal, or less:  a)  South Wall:  On November 15, 2016, and at times prior, employees were exposed to hazards associated with not being able to de-energize equipment in the event of an emergency due to a full 55 gallon barrel of Premium Windshield Wash blocking the electrical panel.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) Green Nissan, LLC: On or about November 15, 2016, and at times prior, employees were exposed to chemical hazards while working with chemicals such as but not limited to; Dow DOT 3 BF372LB Brake Fluid, 999MP-AM006P NISSAN TRAN FLUSH, and Nissan Genuine Matic Fluid D ATF. The employer failed to ensure that each container of hazardous chemicals in the workplace was labeled with the product identifier and words, pictures, symbols, or combination thereof, which provides at least general information regarding the hazards of the chemicals.     b) Green Nissan, LLC: On or about November 15, 2016, and at times prior, employees were exposed to chemical hazards while working with chemicals such as but not limited to; Dow DOT 3 BF372LB Brake Fluid, 999MP-AM006P NISSAN TRAN FLUSH, and Nissan Genuine Matic Fluid D ATF. The employer failed to provide the required safety data sheet for each hazardous chemical in use.     c) Green Nissan, LLC: On or about November 15, 2016, and at times prior, employees were exposed to chemical hazards while working with chemicals such as but not limited to; Dow DOT 3 BF372LB Brake Fluid, 999MP-AM006P NISSAN TRAN FLUSH, and Nissan Genuine Matic Fluid D ATF. The employer failed to provide effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area.
