29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:       a) Spray Booth, Cabinet Shop:  On or about November 16, 2016 and at times prior, employees were exposed to respiratory hazards from chemicals such as, but not limited to; acetone, benzene, titanium dioxide, butanol, formaldehyde (Valspar Valtec PC W LAC 275), and Naphtha, ethyl alcohol, naphthalene, (Valspar Clear Wiping Stain Base) while using these chemicals in various phases of the wood treatment process. The employer required respirators but did not have a procedure for selecting the appropriate respirator in that the 3M filtering face piece respirators (model 7503) as required in 1910.134(c)(1)(i).       b) Spray Booth, Cabinet Shop:  On or about November 16, 2016 and at times prior, employees were exposed to respiratory hazards from chemicals such as, but not limited to; acetone, benzene, titanium dioxide, butanol, formaldehyde (Valspar Valtec PC W LAC 275), and Naphtha, ethyl alcohol, naphthalene, (Valspar Clear Wiping Stain Base) while using these chemicals in various phases of the wood treatment process. The employer did not provide medical evaluations to employees required to use the respirators as required in 1910.134(c)(1)(ii).       c) Spray Booth, Cabinet Shop:  On or about November 16, 2016 and at times prior, employees were exposed to respiratory hazards from chemicals such as, but not limited to; acetone, benzene, titanium dioxide, butanol, formaldehyde (Valspar Valtec PC W LAC 275), and Naphtha, ethyl alcohol, naphthalene, (Valspar Clear Wiping Stain Base) while using these chemicals in various phases of the wood treatment process. The employer did not provide fit testing procedures for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iii).       d) Spray Booth, Cabinet Shop:  On or about November 16, 2016 and at times prior, employees were exposed to respiratory hazards from chemicals such as, but not limited to; acetone, benzene, titanium dioxide, butanol, formaldehyde (Valspar Valtec PC W LAC 275), and Naphtha, ethyl alcohol, naphthalene, (Valspar Clear Wiping Stain Base) while using these chemicals in various phases of the wood treatment process. The employer did not provide procedures for proper use of respirators in routine and reasonably foreseeable emergency situations for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iv).       e) Spray Booth, Cabinet Shop:  On or about November 16, 2016 and at times prior, employees were exposed to respiratory hazards from chemicals such as, but not limited to; acetone, benzene, titanium dioxide, butanol, formaldehyde (Valspar Valtec PC W LAC 275), and Naphtha, ethyl alcohol, naphthalene, (Valspar Clear Wiping Stain Base) while using these chemicals in various phases of the wood treatment process. The employer did not provide procedures for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators of employees required to use the respirators as required in 1910.134(c)(1)(v).       f) Spray Booth, Cabinet Shop:  On or about November 16, 2016 and at times prior, employees were exposed to respiratory hazards from chemicals such as, but not limited to; acetone, benzene, titanium dioxide, butanol, formaldehyde (Valspar Valtec PC W LAC 275), and Naphtha, ethyl alcohol, naphthalene, (Valspar Clear Wiping Stain Base) while using these chemicals in various phases of the wood treatment process. The employer did not provide training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations for employees required to use the respirators as required in 1910.134(c)(1)(vii).       g) Spray Booth, Cabinet Shop:  On or about November 16, 2016 and at times prior, employees were exposed to respiratory hazards from chemicals such as, but not limited to; acetone, benzene, titanium dioxide, butanol, formaldehyde (Valspar Valtec PC W LAC 275), and Naphtha, ethyl alcohol, naphthalene, (Valspar Clear Wiping Stain Base) while using these chemicals in various phases of the wood treatment process. The employer did not provide training on putting on, removing, or the limitations of the respirators for employees required to use the respirators as required in 1910.134(c)(1)(viii).       h) Spray Booth, Cabinet Shop:  On or about November 16, 2016 and at times prior, employees were exposed to respiratory hazards from chemicals such as, but not limited to; acetone, benzene, titanium dioxide, butanol, formaldehyde (Valspar Valtec PC W LAC 275), and Naphtha, ethyl alcohol, naphthalene, (Valspar Clear Wiping Stain Base) while using these chemicals in various phases of the wood treatment process. The employer did not establish work-site specific procedures to regularly evaluate the effectiveness of the program as required in 1910.134(c)(1)(ix).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Glacier Woodworking Inc.: On or about November 15, 2016, and at times prior, employees were exposed to; acetone, benzene, titanium dioxide, butanol, formaldehyde (Valspar Valtec PC W LAC 275), and Naphtha, ethyl alcohol, naphthalene, (Valspar Clear Wiping Stain Base) while using these chemicals in various phases of the wood treatment process. The employer failed to ensure that each container of hazardous chemicals in the workplace was labeled with the product identifier and words, pictures, symbols, or combination thereof, which provides at least general information regarding the hazards of the chemicals.    b) Glacier Woodworking Inc.: On or about November 15, 2016, and at times prior, employees were exposed to; acetone, benzene, titanium dioxide, butanol, formaldehyde (Valspar Valtec PC W LAC 275), and Naphtha, ethyl alcohol, naphthalene, (Valspar Clear Wiping Stain Base) while using these chemicals in various phases of the wood treatment process. The employer failed to provide the required safety data sheet for each hazardous chemical in use.    c) Glacier Woodworking Inc.: On or about November 15, 2016, and at times prior, employees were exposed to; acetone, benzene, titanium dioxide, butanol, formaldehyde (Valspar Valtec PC W LAC 275), and Naphtha, ethyl alcohol, naphthalene, (Valspar Clear Wiping Stain Base) while using these chemicals in various phases of the wood treatment process. The employer failed to provide effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area.
