29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Location: Spar deck On or about November 11, 2016, the employer failed to protect employees working from the stationary spar deck from fall hazards of greater than 9-feet to a lower floating dock during the ocean's low-tide. An employee fell from the spar deck to the lower floating dock during the ocean's low-tide and was found deceased in the water.
