29 CFR 1910.134(d)(1)(i): The employer did not select and provide an appropriate respirator based on the respiratory hazard(s) to which the worker is exposed. On or about 17 November 2016, and at times prior thereto, a mason was using a DeWalt Chop Saw to cut brick with a dry method without the use of a NIOSH approved particulate mask, exposing the worker to a respiratory hazard of breathing in Crystalline Silica dust.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns. On or about 17 November 2016, and at times prior thereto, four masons were laying brick while on a partial scaffold that placed them directly under the roof eave and patio ceiling without the use of head protection, exposing the workers to the hazard of being struck by the structure of the residence.
