29 CFR 1910.134(d)(1)(i): The employer did not select and provide an appropriate respirator based on the respiratory hazard(s) to which the worker is exposed.  On or about 17 November 2016, and at times prior thereto, an employee was cutting cement board using a dry method with a hand-held saw in which he was not wearing a NIOSH-approved particulate mask, exposing the employee to the hazards of Crystalline Silica.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  On or about 17 November 2016, and at times prior thereto, four workers were installing siding on an apartment building without the use of head protection, exposing the workers to the hazard of being struck by falling debris, tools, and materials.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about 17 November 2016, and at times prior thereto, two workers were using a pneumatic nail gun to install new fiber cement board siding on an apartment building without the use of eye protection, exposing the workers to the hazard of being struck by flying debris or projectiles.

On or about 17 November 2016, and at times prior thereto, two workers were installing new fiber cement board siding to an apartment building at the fourth tier without the platform being fully decked, exposing the workers to a fall hazard of approximately 28 feet 9 inches to the ground below.

On or about 17 November 2016, and at times prior thereto, four workers were using a 5 foot wide, four tiered scaffold to install fiber cement board siding on an apartment building without being tied into the building, exposing the workers to a fall hazard of approximately 28 feet 9 inches to the ground below.
