29 CFR 1910.213(c)(1): Each circular hand-fed ripsaw shall be guarded by a hood which shall completely enclose that portion of the saw above the table and that portion of the saw above the material being cut. (a) Respondent did not ensure the dado blade of the Rigid Table Saw was guarded by a hood that completely enclosed that portion of the saw above the table and that portion of the saw above the material being cut. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): (a) Rigid Table Saw - On or about November 17, 2016, a worker received an amputation injury to the small finger on the left hand when attempting to re-position the rip fence on the saw while the machine was operating. The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4), dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards. No abatement certification or documentation is required for this item.

29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that employees acquired the knowledge and skills required for the safe application, usage and removal of energy control devices: (a) Ridgid Table Saw - On or about November 17, 2016, the employer did not ensure an employee re-positioning the rip fence was trained as an "Authorized" employee. The employee received an amputation injury to the small finger on the left hand while adjusting the rip fence on the saw with the saw operating. The employee performed this servicing/maintenance activity without the knowledge and skills needed for the safe application, usage, and removal of the energy controls. No abatement certification or documentation is required for this item.
