29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6m) above or below a point of access the employer did not provide one of the following; portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold. Crossbraces shall not be used as a means of access: a) Employees were exposed to 45 ft fall hazard when erecting a tubular welded frame scaffold when climbing the scaffold frames. Location: 12 W 48th Street, New York, N.Y. On or about 10-28-2016 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(2): The employer did not have a competent person determine the feasibility and safety of providing fall protection for employees erecting or dismantling supported scaffolds. Employers are required to provide fall protection for employees erecting or dismantling supported scaffolds where the installation and use of such fall protection is feasible and does not create a greater hazard: a) Employees were exposed to 45 ft fall hazard when erecting a tubular welded frame scaffold. Employees did not have fall protection (were not tied off) when stationary while attaching (drilling) scaffold braces to the building. Location: 12 W 48th Street, New York, N.Y.
