29 CFR 1910.107(c)(2): Open flame or spark producing equipment was located in the spraying area or within 20 feet thereof, and was not separated by a partition.    On or about November 22, 2016 and times prior to the employee was painting vehicle parts in an enclosed room by opening the overhead door approximately 36 inches, covering the opening with a dry type filter, and positioning the shop fan rated for general purpose electric inside the room in front of the filtering media.  Then spraying with a pneumatic spray gun an OMNI flammable base coat containing chemicals such as, but not limited to 75-90% Acetone, 20-50% Xylene, 10-20% Toluene, and 1-5% Stoddard Solvent.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    On or about November 22, 2016 and times prior there to, the employer did not ensure the plumbed eyewash station at the north end of the shop was functional by performing monthly tests and ensuring equipment and material were not blocking access to the eyewash. Also the eyewash is so located that mechanics with potential exposures to corrosive materials would have to walk over 75 feet in distance through the parts area which is a controlled access area, through doors, and across the catwalk of an oil and lubrication service pit.

29 CFR 1910.215(a)(4): Work rests. On offhand grinding machines, work rests shall be used to support the work. They shall be of rigid construction and designed to be adjustable to compensate for wheel wear. Work rests shall be kept adjusted closely to the wheel with a maximum opening of one-eighth inch to prevent the work from being jammed between the wheel and the rest, which may cause wheel breakage. The work rest shall be securely clamped after each adjustment. The adjustment shall not be made with the wheel in motion.    On or about November 22, 2016 and times prior there to, the employer did not ensure the work bench on the bench grinders were properly installed exposing the employees to the potential hazard of getting their fingers or hand drawn in between the rotating stone and the work rest.    1) Delta 8 inch bench grinder; , with the work rest adjusted approximately 1/2 inch from the face of the stone    2) DeWalt Model DW758 Heavy Duty 8 inch bench grinder; with the work rest for the stone mounted on the left spindle adjusted approximately 1/2 in from the face of the stone.    3) DeWalt Model 758 8 inch bench grinder; with no work bench.     The DeWalt grinder with no work bench was put into service by the employer approximately one month ago after the company acquired another company.

29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch:  On or about November 22, 2016 and times prior there to, the employer did not ensure the tongue guard on the bench grinders were properly installed exposing employees to the hazard of being struck by debris, such as stone fragments, or metal filings.  1) Delta 8 inch bench grinder; with the tongue guard adjusted approximately 1/2 inch from the face of the stone  2) DeWalt Model DW758 Heavy Duty 8 inch bench grinder; with the tongue guard for the stone mounted on the left spindle adjusted approximately 1/2 in from the face of the stone.  3) DeWalt Model 758 8 inch bench grinder; with no tongue guard   The DeWalt grinder with no tongue guard was put into service by the employer approximately one month ago after the company acquired another company.

29 CFR 1910.334(a)(3)(i): A flexible cord used with grounding type equipment did not contain an equipment grounding conductor exposing the employees to a potential of electric shock and/or burns.    On or about November 22, 2016 and times prior there to, the employer did not inspect cord and plug equipment to ensure grounding type equipment such as but not limited to the DeWalt Model DW758 Heavy Duty 8 inch bench grinder; have the equipment grounding conductor attached to provide an effective grounding path for the equipment.

29 CFR 1910.157(c)(4): Portable fire extinguishers were not maintained in a fully charged and operable condition exposing employees to possible thermal burns and smoke inhalation.  On November 22, 2016, and time prior there to, the employer did not inspect and maintain portable fire extinguishers.  The one fire extinguisher in the old shop showed the indicator reading below fully charged.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  This exposes employees to unknowingly being exposed to hazardous chemicals, and delayed treatment and diagnosis to a hazardous chemical exposure in the workplace.   On or about November 22, 2016 and times prior there to, the employer did not develop and maintain a site specific, written hazard communication program.  The site uses chemicals such as, but not limited to, engine oil, engine coolants, lubricating grease, and automotive paints.  The employer did not have a written program, knowledge of the location of SDS/MSDS, labeling procedures, or chemical training.
