29 CFR 1926.251(c)(1): Employers must not use improved plow-steel wire rope and wire-rope slings with loads in excess of the rated capacities (i.e., working load limits) indicated on the sling by permanently affixed and legible identification markings prescribed by the manufacturer:   On or about November 22, 2016 - job site at 81-10 135th Street, Briarwood, NY 11435  Employees used a 1/2-inch fiber core wire rope sling with a rated maximum capacity of 3200 pounds to lift a steel I-beam that weighed 6208 pounds.  The sling snapped while being lifted and fell 40-feet to the lower level.  WRITTEN ABATEMENT CERTIFICATION IS REQUIRED PERSUANT TO 29 CFR 1903.19

29 CFR 1926.251(c)(9): Slings were not padded or protected from the sharp edges of their loads:  On or about November 22, 2016 - job site at 81-10 135th Street Briarwood, NY 11435  Employees performing steel erection activities used a 1/2-inch fiber core wire rope sling to rig a steel beam. No padding was used to protect the wire rope sling from the sharp edges of the beam.  WRITTEN ABATEMENT CERTIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19

29 CFR 1926.251(c)(16): Wire rope slings shall have permanently affixed, legible identification markings stating size, rated capacity for the type(s) of hitch(es) used and the angle upon which it is based, and the number of legs if more than one:  On or about November 22, 2016 - job site at 81-10 135th Street, Briarwood, NY 11435  Employees used a 1/2-inch fiber core wire rope as a choker with a rated maximum capacity of 3200 pounds to lift a steel I-beam that weighed 6208 pounds to the 4th floor.  This rope did not have a permanent label indicating its size and rated capacity.     WRITTEN ABATEMENT CERTIFICATION IS REQUIRED PERSUANT TO 29 CFR 1903.19

On or about November 22, 2016 - 3rd floor at job site, 81-10 135th Street, Briarwood, NY 11435  An employee was tending the beam with a tag line was exposed to a fall hazard of approximately 30-feet to the ground.
