29 CFR 1926.102(b): Criteria for protective eye and face protection.  29 CFR 1926.102(b)(1)(i): ANSI/ISEA Z87.1-2010, Occupational and Educational Personal Eye and Face Protection Devices, incorporated by reference in � 1926.6;  a.  On the site where pneumatic nail guns were used to nail down sheets of plywood, the employer did not provide ANSI Approved eye protection thereby exposing employees to a contact hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On the site where employees were observed on the roof of the assisted living facility installing plywood sheeting, the employer did not provide or enforce the use of fall protection thereby exposing employees to a fall hazard.

29 CFR 1926.503(a)(2): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:  29 CFR 1926.503(a)(2)(ii): The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;  a.  On the site where employees were laying sheets of plywood, the employer did not provide fall protection training to enable employees how to determine the fall protection needed and the proper way to install the fall protection system thereby exposing employees to a fall hazard.
