29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)  NOTE TO CSHO: USE THIS OPTION ONLY IN CASES WHERE THE INFEASIBILITY/GREATER HAZARD EXCEPTION IS NOT IN ISSUE.  29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a. Employees performing framing work are not being protected from 8 feet 3 inches, and up to 22 feet 3 inches, fall hazards by a fall protection system.  The employer routinely fails to assure effective protection against falls as required by the standard, as demonstrated on November 28, 2016, when employees were roof framing of a two-story residence at 4072 Coastal Avenue, Jacksonville Beach, Florida 32250 without fall protections and were exposed to fall hazard of up to 22 feet 3 inches above the surrounding ground.  AJ New Construction and Repair, Inc. previously committed a repeat-serious violation of this standard on August 22, 2016, with respect to a workplace at 55 N. Roscoe Blvd., Ponte Vedra, Florida which became a final order on November 1, 2016 (Inspection No. 1171443).      AJ New Construction and Repair, Inc. previously committed a willful violation of this standard on June 4, 2016, with respect to a workplace at 1684 State Street, Jacksonville, Florida which became a final order on September 14, 2016 (Inspection No. 1152474).     AJ New Construction and Repair, Inc. previously committed a repeat-serious violation of this standard on April 14, 2016, with respect to a workplace at 506 Heron Landing, lot 161, Durbin Crossing, Saint Johns, Florida which became a final order on September 14, 2016 (Inspection No. 1140100).     AJ New Construction and Repair, Inc. previously committed a repeat-serious violation of this standard on December 10, 2015, with respect to a workplace at 59 Bonair Dr., Saint Augustine, Florida which became a final order on March 22, 2016 (Inspection No. 1111227).     AJ New Construction and Repair, Inc. previously committed a serious violation of this standard on November 10, 2014, with respect to a workplace at 3805 Valverde Circle (Lot 7), Jacksonville, Florida which became a final order on January 26, 2015 (Inspection No. 1007334).    Conin Framing Group, Inc. previously committed a repeat-serious violation of this standard on April 24, 2014, with respect to a workplace at 16592 Sand Hill Drive, Jacksonville, Florida which became a final order on May 29, 2014 (Inspection No. 974198).        Conin Framing Group, Inc. previously committed a repeat-serious violation of this standard on February 6, 2014, with respect to a workplace at 3722 Crossview Drive, Jacksonville, Florida which became a final order on February 18, 2014 (Inspection No. 957666).
