29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift. a) On or about November 16, 2016 and at times prior thereto, the employer did not ensure a "competent person" inspected trenches and excavations prior to the start of work and/or as needed throughout the shift. Employees were working to install pipe for a storm drain in an excavation at a depth ranging from 5 feet up to 6.0 feet. Employees did not have the protection of sloping and/or other engineering controls such as an appropriate trench box throughout pipe installation. Abatement certification IS required for this item.
