29 CFR 1926.1101(f)(2)(i): The employer with a work operation covered by the asbestos standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace:    a) In the facility, on or about September 30, 2016 - The employer did not ensure that an exposure assessment was conducted by a "competent person" prior to an employee entering the Dead Air North and Dead Air South doors on the #2 Boiler and potentially disturbing asbestos-containing packing material on the doors while conducting a hydrostatic test of the boiler.      b) In the facility, on or about October 3, 2016 - The employer did not ensure that an exposure assessment was conducted by a "competent person" prior to employees removing rust and metal scale with a wire brush from asbestos-containing packing material located on the Sixth Floor Penthouse NE door and the Third Floor Air Heater East Door.

29 CFR 1926.1101(g)(9)(v): The employer did not ensure that employees performing Class III asbestos work wore respirators selected, used, and fitted pursuant to 29 CFR 1926.1101(h):Note:  This paragraph applies to work involving disturbance of thermal system insulation or surfacing material, work for which the employer has not produced a negative exposure assessment, or where monitoring results show the PEL has been exceeded.    a) In the facility, on or about September 30, 2016 - The employer did not ensure that employees performing inspection work that could potentially disturb thermal system insulation on the #2 Boiler wore respirators selected, used and fitted pursuant to 29 CFR 1926.110(h).  Employees were engaged in work in which the employer did not produce a negative exposure assessment.
