29 CFR 1910.1200(e)(1) (as referenced by 29 CFR 1926.59): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  a) On or about November 30, 2016 or prior there to:   A worker was dry cutting concrete before the installation of new concrete at a residence.   Concrete contains silica, a hazardous chemical when airborne can cause lung disease and silicosis.     The employer had not developed a written hazard communication program that included addressing the hazards of potential exposure to silica.  NOTE:  Abatement certification is required for this item.

Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. 29 CFR 1910.134(c): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use.  a) On or about November 30, 2016, or prior there to:   A worker was dry cutting approximately 26 feet of concrete at a residence.   During this operation, employees were exposed to dust which contained respirable silica as the concrete was estimated to contain 20% silica per OSHA bulk sampling analysis.   Employees were exposed to the hazard of crystalline silica, and a respiratory protection program was not utilized for this operation and employee.  NOTE:  Abatement certification and supporting documentation are required for this item.  Mr. Mudd-Concrete Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.134(c), which was contained in OSHA inspection number #698718, citation number 1, item number 1a and was affirmed as a final order on March 19, 2013, with respect to a workplace located at 106 53rd St, Garden City, Idaho 83714.

During this operation, employees were exposed to dust which contained respirable silica as the concrete was estimated to contain 20% silica per OSHA bulk sampling analysis.   Employees were exposed to the hazard of crystalline silica, and an airborne assessment of respirable dust containing silica had not been conducted for this operation.  NOTE:  Abatement certification and supporting documentation are required for this item.  Mr. Mudd-Concrete Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.134(d)(1)(iii), which was contained in OSHA inspection number #698718, citation number 1, item number 1b and was affirmed as a final order on March 19, 2013, with respect to a workplace located at 106 53rd St, Garden City, Idaho 83714.

Employees were exposed to the hazard of crystalline silica, and comprehensive training addressing respirator use when employees were exposed to silica hazards was not conducted.  NOTE:  Abatement certification and supporting documentation are required for this item.
