The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that: On or about November 30, 2016, at the above addressed jobsite, the employer did not ensure that a cave-in protection system was used to protect three employees who were observed working in an excavation measuring approximately 20 feet long, 10 feet wide, and 8 feet deep.
