OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards while using an automotive lift: (a) On or about December 1, 2016, and at times prior the employer did not ensure that employees were safe from crushing and struck-by hazards in that the following lifts were noted with deficiencies: (1) Rotary lift, model FP-46A, serial #L610267, located in bay two, inoperable locking mechanism. The locking device was not functioning properly and jack stands were not used while the lock was not engaged. (2) Rotary lift, model FP-46A-44, serial #L610262, located in bay six was not lowered to rest on the locking mechanism while the lift was raised and in use. (3) Rotary lift, model FP-46A-44, serial # illegible, located in bay seven, inoperable locking mechanism. (4) Rotary lift, model FP-46A-44, serial # L610266, located in bay eight, inoperable locking mechanism. 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) On or about December 1, 2016, employees were exposed to injuries from flying parts while using a hydraulic shop press where the employer failed to ensure guards were in place prior to use to protect employees. (b) On or about December 1, 2016, employees were exposed to amputation and struck by hazards while using an Aamco #6950 brake lathe, where the employer failed to ensure guards were in place prior to use to protect employees.
