29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers: On or about October 31, 2016 at the above referenced worksite, employees were engaged in demolition and rebuild activities where they were exposed to electrical hazards, including shock and burns. Employees were exposed to fall hazards from unprotected openings in a floor a wall and falls from ladders. The employer failed to inspect and / or have a competent person recognize any and all defects and associated hazards. Employees were thereby exposed to electrical hazards and falls from scaffolds with inadequate fall protection. No abatement is required for this item.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity. On or about October 31, 2016 at the above referenced worksite, employees of Sjostroms & Sons, Inc. were required to work from a Bakers Scaffold in the performance of their duties. The employer failed to inspect and / or have a competent person recognize any and all defects and associated hazards. At the time of inspection, a 2x4 installed as a "guardrail" was too low to meet minimum height requirements. Employees were thereby exposed to falling approximately 60 feet to the ground. No abatement is required for this item.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person. On or about October 31, 2016 at the above referenced worksite, employees of Sjostroms & Sons, Inc. were required to work from a scaffold in the performance of their duties. The employer failed to have a competent person erect and / or alter a scaffold. Employees were thereby exposed to falls in excess of 60' to the next lower level. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.405(b)(2): Covers and canopies. All pull boxes, junction boxes, and fittings shall be provided with covers. If metal covers are used, they shall be grounded. In energized installations each outlet box shall have a cover, faceplate, or fixture canopy. Covers of outlet boxes having holes through which flexible cord pendants pass shall be provided with bushings designed for the purpose or shall have smooth, well-rounded surfaces on which the cords may bear. a. On or about October 31, 2016 at the above referenced worksite, employees were engaged in demolition and / or Gut-ReHab activities. Employees were working in close proximity to an energized circuit breaker panel that had its cover removed. The panel was listed and labeled as 480 VAC. Employees were thereby exposed to electrical hazards. b. On or about October 31, 2016 at the above referenced worksite, employees were engaged in demolition and / or Gut-ReHab activities. Employees were working in close proximity to an un-covered raceway containing energized conductors. The raceway was servicing a 120 VAC outlet, as outlined in item c. Employees were thereby exposed to electrical hazards. c. On or about October 31, 2016 at the above referenced worksite, employees were engaged in demolition and / or Gut-ReHab activities. Employees were working in close proximity to an open junction box containing energized conductors. The junction box was in-line from the panel listed in item a and the outlet mentioned in item b. Employees were thereby exposed to electrical hazards. No abatement is required for this item.

29 CFR 1926.451(g)(4)(ii): The top edge height of top-rails or equivalent member on supported scaffolds manufactured or placed in service after January 1, 2000 shall be installed between 38 inches (0.97 m) and 45 inches (1.2 m) above the platform surface. The top edge height on supported scaffolds manufactured and placed in service before January 1, 2000, and on all suspended scaffolds where both a guardrail and a personal fall arrest system are required shall be between 36 inches (0.9 m) and 45 inches (1.2 m). When conditions warrant, the height of the top edge may exceed the 45-inch height, provided the guardrail system meets all other criteria of paragraph (g)(4): On or about October 31, 2016 at the above referenced worksite, employees of Sjostroms & Sons, Inc. were required to work from a bakers scaffold at a window opening behind a 32 inch high guardrail. The employer failed to ensure that the top-rail of the guardrail system was installed at an adequate height to prevent falls of approximately 60' to the ground. No abatement is required for this item.
