29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done as required by 29 CFR 1910.147(d)(1)-(6): (a) Employees who performed cleaning activities were not required to: (1) know the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy, (2) turn off and shut down the machines (3) physically locate and operate energy isolating devices in such a manner as to isolate the machine or equipment from the energy source, (4) affix lockout or tagout devices to each energy isolating device, (5) prior to starting work on machines that have been locked out or tagged out, verify that isolation and deenergization of the machine or equipment have been accomplished. On or about November 7, 2016 and thereafter,; in the Assembly Department on the third floor, employees cleaned the rollers on the Black Brothers 22-D Adhesive Spreader, Series 875 while it was still energized exposing employees to in-running nip points.

29 CFR 1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control. (a) On or about November 7, 2016 and thereafter, in the Assembly Department of the third floor; affected employees who were required to perform cleaning activities were not trained as authorized employees.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. (a) On or about November 7, 2016 and thereafter, on the third floor, the Black Brothers Co. #10-063 (#22-D Roller Coaters) had in-running nip points created by rollers rotating in toward each other which were not guarded to prevent employees from reaching under the guard.

29 CFR 1910.212(a)(2): General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself. (a) On or about November 7, 2016 and thereafter, on the third floor, the Black Brothers Co. #10-063 (#22-D Roller Coaters) had guards on the infeed and outfeed which were not secured allowing employees to open and be exposed to inrunning nip points.
