29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about December 8, 2016, the employer did not administer an effective hearing conservation program that included noise monitoring, required use of suitable hearing protectors, training, audiometric testing, and recordkeeping for employees shredding tires at the CM Tire Shredder and an employee was exposed to continuous noise levels at 80.0-percent of the permissible daily noise exposure, or an equivalent sound level of 88.4 dBA, during the 479-minute sampling period; exposure calculations include a zero increment of 1-minute not sampled.

On or about December 8, 2016, the employer did not evaluate, develop and document a personal protective equipment hazard assessment for the tire cutting tasks performed, nor did they complete a written certification that included the name of the person who certified that the evaluation had been performed and the date that the hazard assessment was completed.

29 CFR 1910.138(a): The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasion; punctures; chemical burns; thermal burns; and harmful temperature extremes. On or about December 8, 2016, the employer provided the employees with Boss Flexi Grip 8426L gloves and the employees hands were not protected against lacerations or severe abrasions when handling the shredded and cut tire pieces.
