29 CFR 1926.502(h)(1)(v): The safety monitor had other responsibilities which could take the monitor's attention from the monitoring function:  a. On or about December 7, 2016, on a 40' x 40' foot wide, 3:12 pitch and flat roof were not protected from fall hazards in that the safety monitor had other responsibilities other than monitoring the safety of the employees installing shingles.  The safety monitor turned his back to the other employees and was placing material under the awning on a corner of the flat roof.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a. Employees installing roof shingles on a 40' x 40' foot wide roof at elevations of 6 feet or more above ground are not being protected from fall hazards by a fall protection system or an alternative fall protection measure under another provision such as the use of a monitoring system.  The employer fails to assure effective protection against falls as required by the standard, as demonstrated on December 7, 2016, when employees installing roof shingles on a 3:12 pitch roof and flat roof at 5 Ocean Shore Drive, Ormond Beach, FL 32176, were exposed up to an 12.5 feet fall hazard above the ground in that they did not have an adequate safety monitor system nor fall protection system installed.   WKL Roofing, LLC was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1144080, citation number 02, item number 001  and was affirmed as a final order on July 12, 2016, with respect to a workplace located at 13 Beech Wood Drive, Ormond Beach, FL 32176.  WKL Roofing, LLC was previously cited for a  violation of an equivalent Occupational Safety and Health Standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1108115, citation number 03, item number 001 and was affirmed as a final order on January 8, 2016, with respect to a workplace located at 4655 Spruce Creek Road, Units A-H, Port Orange, FL 32127.  WKL Roofing, LLC was previously cited for a violation of an equivalent Occupational Safety and Health Standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 981242, citation number 02, item number 001 and was affirmed as a final order on March 5, 2015, with respect to a workplace located at 1205 Ridgewood Avenue, Daytona Beach, FL 32114.
