Location:    325 Kent Avenue, Brooklyn, NY. 4th Floor Courtyard North Side of South Tower.    a)    Three employees were installing clips while working on a Dunlop 12000 mast climber scaffold work platform that was not fully planked.  On or about 12/09/2016.

29 CFR 1926.451(b)(5)(i): The end of a platform 10 feet or less in length extended over its support more than 12 inches and the platform was not designed and installed so that the cantilevered portion of the platform is able to support employees and/or materials without tipping, or has guardrails which block employee access to the cantilevered end    Location:    325 Kent Avenue, Brooklyn, NY. 4th Floor Courtyard North Side of South Tower.    a)             The platform planks of the Dunlop 12000 mast climber scaffold were not secured and extended more than 12 inches over its support. An employee fell two stories when the cantilevered platform plank tipped. On or about 12/09/2016.    b)            The platform planks of the Dunlop 1200 mast climber scaffold were not secured and extended more than 12 inches over the support on the scaffold used by employees on or about 04/11/2017.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet (3.1m) above a lower level, not otherwise specified in paragraphs (g)(1)(I) through (g)(1)(vi) of this section, was not protected from falling to that lower level by use of personal fall arrest systems or guardrail systems meeting the requirement of paragraph (g)(4) of this section:    IN THE ALTERNATIVE:  29 CFR 1926.451(g)(2): Effective September 2, 1997, the employer did not have a competent person determine the feasibility and safety of providing fall protection for employees erecting or dismantling a scaffold. Employers are required to provide fall protection for employees erecting dismantling supported scaffolds where the installation and use of such protection is feasible and does not create a greater hazard.      Location:        325 Kent Avenue, Brooklyn, NY. 4th Floor Courtyard North Side of South Tower.    a)        Employee was working or altering the Dunlop 12000 mast climber scaffold and was not utilizing a complete fall protection system.  The employee fell two stories to the courtyard.  On or about 12/09/2016.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds per employee attached, or were not designed, installed and used:    Location:        325 Kent Avenue, Brooklyn, NY. 4th Floor North of South Tower.    a)                Employees were working on the exterior façade of the building approximately 20 feet high from a Dunlop 12000 mast climber scaffold. The employer did not determine that the anchorage attachments used were not capable of supporting 5,000 pounds, as part of their fall protection systems.  The Professional Engineer's Designed anchorage point was not used by the employer and anchorages were attached to mast sections under the decking.  On or about 12/09/2016 and 04/11/2017.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:    Location:        325 Kent Avenue, Brooklyn, NY. 4th Floor North of South Tower.    a)                Employees were working on the exterior façade of the building approximately 20 feet high from a Dunlop 12000 mast climber scaffold. The employees were attached their PFAS 6 foot lanyards to a 4 foot lanyard attached to the underside of the mast.  The employee would be able to free fall 10 feet from the work platform. On or about 12/09/2016 and 04/11/2017.
