29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: a) On or about December 13, 2016 and at times prior to, the employer did not ensure that employees who operated forklift truck moving pallets in the warehouse were trained and evaluated, exposing employees to struck-by and crush hazards. 29 CFR 1910.178(m)(3): Unauthorized personnel shall not be permitted to ride on powered industrial trucks. A safe place to ride shall be provided where riding of trucks is authorized. a) On or about December 13, 2016 and at times prior to, employees standing on the forks or on a pallet were raised with the forklift to get materials from the racks or pop on lights celling, exposing employees to a fall hazard of about 10-15 feet high.
