29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. On or about December 12, 2016 and at times prior thereto, at a construction site located at or near 915 S. Scott St. Little Rock, Arkansas, employees used pneumatic nail guns without eye protection. This condition exposed employees to the hazard of being struck-by nails or other materials while performing decking.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501. On or about December 12, 2016 and times prior thereto, employees were attaching decking and walking on rafters at a residential construction site at a height greater that 6 (six) feet. The employees were not utilizing any form of fall protection, exposing them to the hazard of falling from the second story of the structure.
