29 CFR 1926.20(b)(2): The employer did not insure and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by the competent person. The competent should have been capable of eliminating the hazard after discovering the employee was tying off to a lifting magnet instead of the prescribed methods as specified in 1926.502 and once the hazard was identified that item should have been removed from the worksite. (a) Frequent and regular inspections of the job site were not conducted by a competent person to ensure hazardous situations were found and corrected.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. (a) Employees installing metal decking from a elevated walking/working surface were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 38 feet.

29 CFR 1926.761(b): Fall hazard training. The employer shall train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program. (a) The employer did not ensure that employees exposed to potential fall hazards had been trained to recognize and minimize the fall hazards associated with their work. Employees were performing steel erection activities and were not properly tied off.
