29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: a). Tank Battery Area: On or about December 12, 2016, and at times prior, employees were exposed to respiratory hazards such as but not limited to, Hydrogen Sulfide, while thiefing oil from storage tanks. The employer failed to identify and evaluate employee exposures to respiratory hazards, identification of the contaminant's chemical state and identification of the contaminant's physical form.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a). On or about, December 12, 2016, and at times prior, employees were exposed to chemical hazards from unlabeled and mislabeled containers of chemicals including, but not limited to, Aqualuxus K, unknown chemicals in a 3 L drinking jug, and 55 gallon drum of solvent. b). On or about, December 12, 2016, and at times prior, employees were exposed to chemical hazards from not maintaining safety data sheets for chemicals including, but not limited to, Aqualuxus K, Sulfuric Acid, Acetic Acid, Hydrochloric Acid, Hexanes, Propane, Emulsotron X-8461. c). On or about, December 12, 2016, and at times prior, employees were exposed to chemical hazards from inadequate information and training for chemicals including, but not limited to, Aqualuxus K, Sulfuric Acid, Acetic Acid, Hydrochloric Acid, Hexanes, Propane, Emulsotron X-8461, and Hydrogen Sulfide.
