29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    (a) On or about 1/9/2017, employees of Tri-State Shearing and Bending were exposed to noise hazards because the employer failed to implement an effective and continuing hearing conservation program. The following are instances where the time-weighted average exceeded 85 dBA:        (1) A shop guy assigned to the forklift was exposed to 90.38% of the dose, which is equivalent to 89.2 dBA during a period of 438 minutes. Zero exposure was assumed for 42 minutes.         (2) A shop guy assigned to the press break was exposed to 111.2% of the dose, which is equivalent to 90.7 dBA during a period of 395 minutes. Zero exposure was assumed for 85 minutes.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a) On or about 1/9/2017, employees of Tri-State Shearing and Bending were exposed to chemical hazards because the employer failed to train shop guys on the hazards of the LPG, paint, and hydraulic fluid that they used in the work area.
