29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New townhome construction on Lot 30, Rear porch roof: On or about December 7, 2016, and at times prior, the employer exposed employees to fall hazards of 11-feet from the lower level, in that a fall protection system was not provided to an employee working from a 4/12 pitched roof engaged in metal roofing activities with no fall protection system in place. Miguel Sosa was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 994176, citation number 1, item number 1 and was affirmed as a final order on 10/07/2014, with respect to a workplace located at Corner of Redwine St. and Gaines St., Norcross, GA 30071.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) New townhome construction located on Lot #30, Rear Porch Roof: On or about December 7, 2016, and at times prior, the employer exposed employees to falls of approximately 11-feet to the lower level, in that the ladder provided did not reach or extend at least 3-feet past the landing to provide employees with safe access on and off the roof. Miguel Sosa was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1) , which was contained in OSHA inspection number 994176, citation number 1 , item number 2 and was affirmed as a final order on 10/07/2014, with respect to a workplace located at the corner of Redwine St. and Gaines St., Norcross, GA 30071.
