29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) Thermal Treatment Island; On or about November 23, 2016 and at times prior thereto the employer exposed employees to burn hazards in that employees were not required to wear appropriate personal protective equipment while working on the Thermal Treatment Island system, which included opening the bottom of the individual reactors which allowed scalding water, steam, and sludge (approximately 215 degrees Fahrenheit) to drain and splash out onto the employees.

29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D): a) Thermal Treatment Island; On or about November 23, 2016 and at times prior thereto the employer exposed employees to potential hazardous energy sources in that the written procedure for the lockout/tagout of the Thermal Treatment Island system which includes the individual reactors did not have clear and specific steps for isolating, securing, and verifying that all hazardous energy sources (thermal) had been controlled.
