29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:      (a) On or about November 9, 2016, one or more employees were exposed to the hazard of unexpected machine or equipment start-ups, energizations or releases of stored energy in that the employer did not have an energy control program as required by standard.  On November 9th, 2016, an employee did suffer a partial leg amputation when the employee's left leg became entangled in an unguarded screw conveyor which was in operation.       Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

29 CFR 1910.212(a)(2): Guard(s) on machine(s) were not affixed to the machine or secured elsewhere when attachment to the machine was not possible:   (a) On or about November 9th, 2016, and at certain times before, employees were exposed to the hazard of becoming entangled in a screw conveyor due to a section of the conveyor's top guard not being secured in place.  On November 9th, 2016, an employee suffered a partial leg amputation when the employee's left leg became entangled in a partially unguarded screw conveyor which was in operation.     Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

29 CFR 1910.272(d): The employer did not develop and implement an emergency action plan meeting the requirements contained in 1910.38(a):   (a) On or about November 9, 2016, and at certain times before, employees were exposed to potential fire, smoke or other injuries in that the employer had not developed or implemented an emergency action plan as required by standard.  On November 9th, 2016, an employee did suffer a partial leg amputation when the employee's left leg became entangled in an operating screw conveyor requiring an emergency response.   Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

29 CFR 1910.272(e)(1)(ii): Current employees, and new employees prior to starting work in the grain handling facility were not trained in the specific procedures and safety practices applicable to their job tasks including but not limited to working around dangerous, energized, and unguarded, moving machine parts:   (a) On or about November 9, 2016, and at certain times before, one or more employees were exposed to serious injuries in that they had not been trained in ensuring the integrity of the guarding system on a screw conveyor that was in operation.  On November 9, 2016. an employee suffered a partial leg amputation when the employee's left leg became entangled in an operating screw conveyor which was partially unguarded.   Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
