29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area. This standard is applicable to construction employment as defined by 29 CFR 1926.59:      The employer is failing to train employees on the hazards associated with using and working with chemicals in the work place.  This most recently occurred on December 15, 2016 at the facility located at 2325 W. Schimmer Rd, Grand Island, NE 68801.  The employer has employees performing welding operations during the steel erection construction of a new commercial building.

29 CFR 1926.502(b)(9): The employer failed to ensure that wire rope used as a top rail was flagged at 6-foot intervals with high-visibility material.    The employer is failing to ensure that all employees exposed to fall hazards while engaged in steel erection activities are properly using guardrail systems.  This most recently occurred on December 15, 2016 on the jobsite located at 2325 W. Schimmer Rd, Grand Island, NE 68801.  Employees were setting metal decking on the roof of a newly constructed commercial building where the edge is approximately 20 feet above the ground.  Wire rope is being used as the top rail of their guardrail system and it is not flagged with highly visible material at 6 foot intervals.

This standard is applicable as defined by 29 CFR 1926.760(d)(2):    The employer is failing to ensure that all employees exposed to fall hazards while engaged in steel erection activities are inspecting their personal fall protection.  This most recently occurred on December 15, 2016 on the jobsite located at 2325 W. Schimmer Rd, Grand Island, NE 68801.  Employees are setting metal decking on the roof of a newly constructed commercial building where the leading edge is approximately 21.5 feet above the ground.  The personal fall arrest harness used by one employee is worn, torn, and damaged.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.    The employer is failing to ensure that all employees exposed to fall hazards while engaged in steel erection activities are utilizing fall protection.  This most recently occurred on December 15, 2016 on the jobsite located at 2325 W. Schimmer Rd, Grand Island, NE 68801.  Four employees are setting metal decking on the roof of a newly constructed commercial building where the leading edge is approximately 21.5 feet above the ground.  One of the employees fell from the leading edge to the dirt ground below.

29 CFR 1904.29(b)(3): How quickly must each injury or illness be recorded? You must enter each recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness has occurred.    The employer is failing to record injuries on the OSHA 300 Log within the required seven calendar days.  This was most recently identified on or about December 15, 2016 when an accident occurred at the facility located at 2325 W. Schimmer Rd, Grand Island, NE 68801 where an employee fell approximately 21.5 feet and required hospitalization.  Upon review of the OSHA 300 Logs it was identified that the injury was not recorded until sometime in 2017 which is more than the required seven days after the accident.
