29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. (a)I'll Do It Constructors, LLC at 1111 East 7th Street, Dell Rapids, SD 57022: On and prior to December 19, 2016, the exposing employer did not ensure employees performing work on a personnel platform attached to a rough terrain forklift, were protected by a guardrail system that enclosed the platform. The front of the personnel platform was missing the guardrail system to include a toprail and midrail. This condition exposed employees to fall hazards of up to approximately 40 feet while installing horizontal 2x12 inch lumber to a hopper enclosure.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a)I'll Do It Constructors, LLC at 1111 East 7th Street, Dell Rapids, SD 57022: On and prior to December 19, 2016, the exposing employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet or more above a lower level was protected from falling by use of a guardrail system, a safety net system, or a personal fall arrest system. An employee sustained serious injuries after falling approximately 22 feet while attempting to move horizontally on a 2x12 inch board to fix cross-bracing. This condition exposed employees to a fall hazard of approximately 22 feet.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. (a)Ill Do It Constructors, LLC at 1111 East 7th Street, Dell Rapids, SD 57022: On and prior to December 19, 2016, the exposing employer did not ensure that each employee involved in the construction of a hopper enclosure, had been trained to recognize the hazards associated with working at elevations over 6 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not been provided fall protection training. The condition exposed employees to the hazard of falling from an elevation of approximately 22 feet.
