29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Dells Materials Company at 1111 East 7th Street, Dell Rapids, SD 57022:  On and prior to December 19, 2016, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. A subcontractor employee was moving from one side to the other of a 2x12 inch when he fell approximately 22 feet. Subcontractor employees were not using fall protection while constructing an insulated hopper enclosure.  The condition exposed a subcontractor to a fall hazard of approximately 22 feet.     Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
